Piky 430/26, Dejvice, 160 00 Praha 6, Czech Republic, ID No.: 043 58 015, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, Insert 246397 (“Dazzle Pictures”). 

These Terms of Use (“Terms”) govern any access to and use of the Website, as well as all information, recommendations and/or services provided on or through this Website. By using the Website (whether directly or indirectly), you agree to be bound by and act in accordance with these Terms (especially Articles 1 through 3 below). If you do not agree to these Terms, you must leave, and agree not to, access or use the Website.

1. Use of the website

Permitted Use. You may use the Website only (i) via your internet browser, and (ii) for non-commercial exploitation the sole purpose of which is learning about Dazzle Pictures and its services (i.e., for private purposes only). 

Forbidden Use. You must not and agree not to:

1. use the Website and/or data concerning the Website for purposes, via means, and in manners that are not expressly permitted in these Terms (in particular, for commercial purposes and via “screen scraping”),

2. Dazzle Pictures is authorized to conduct all necessary investigations (via any means) to prevent unauthorized use of the Website and/or identify any breaches of these Terms,
3. DazzlePictures  has the absolute right to take all actions or measures (including blocking technology) it considers necessary to prevent or address any unauthorized use of the Website,

1. Dazzle has the absolute right to block your access to the Website or entirely shut down the Website anytime at its discretion and for any reason whatsoever,
2. a link or reference to third-party content (including products and services) on the Website does not imply any connection, partnership, relationship, approval, monitoring or control of Dazzle in relation to such third-party content, 
3. Dazzle reserves any rights not expressly granted in these Terms (especially any right to exploit the Website that is not stipulated herein),
4. the information available on or through this Website is for general information purposes only – no obligations of Dazzle or claims against Dazzle can be derived therefrom, and
5. your use of the Website and information available on or through this Website is done at your own discretion and risk.

2. Warranties and liability

Warranties. Dazzle does not make any, and to the maximum possible extent excludes all, express or implied (including statutory) warranties of any kind including warranties of merchantability, non-infringement of intellectual property, or fitness for any particular purpose in relation to the Website, including, but not limited to, warranties as to:

1. availability, or accessibility of the Website according to your needs,
2. the Website meeting specific requirements, or that the exploitation of the Website will be uninterrupted, timely, secure, or error-free, 
3. relevance, reliability, completeness, or accuracy of any data on or obtained through the Website.

Liability. To the maximum extent permitted by applicable law, Dazzle and its affiliates are not liable or responsible for any damages whatsoever (whether foreseeable or not, including, without limitation, damages for loss of profits, revenues, or data; business interruption; loss of information; loss of opportunity or anticipated savings, indirect or consequential losses; or punitive damages) arising out of or relating to:

1. any direct or indirect use of, or inability to use the Website or information made available on or via the Website, 
2. the functioning or functionality of third-party content on the Website or services concerning the Website (including services of internet service providers and hosting providers),
3. your choices made based on the information available on or via this Website.

Indemnity. You agree to indemnify, defend, and hold harmless Dazzle, its affiliates, licensors, and their respective officers, directors, employees, agents and contractors from and against all claims, losses, liabilities, fines, expenses, damages, and costs, including legal and expert fees, arising out of or relating to (i) your use (or misuse) of this Website, (ii) violation of these Terms, or (iii) infringement of third party’s rights arising out of or related to your use of the Website.

3. General

Personal Data. Collection and use of your personal data is governed by Dazzle’s Privacy Policy.

Amendments. From time to time, Dazzle may unilaterally amend these Terms without further notice. You agree to be bound by and act in accordance with such amended Terms once Dazzle uploads the wording of the amended Terms on this Website. 

No agency. These Terms do not create any agency, partnership, joint venture, or employment relationship.

Governing law. These Terms are governed by the Czech law. You agree that all disputes arising under or in connection with these Terms are submitted to jurisdiction of the competent Czech courts.
